Terms of Service

1. Acceptance of Terms

By accessing and using Creative CPM ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Intellectual Property Rights

2.1 Proprietary Methodology

The Creative CPM creative valuation methodology, including but not limited to the ratio-based weighting system, outcome valuation algorithms, benchmark calculations, and Creative Multiplier metrics, are proprietary and confidential intellectual property of Creative CPM. This methodology is protected by copyright, trade secret law, and other intellectual property rights.

2.2 Database and Benchmarks

All benchmark data, outcome valuations, ratio recommendations, and aggregated market rates provided through the Service ("Oracle Database") are proprietary and confidential. Users may not extract, scrape, copy, or replicate this data for any purpose outside of their authorized use of the Service.

2.3 Prohibited Uses

You specifically agree NOT to:

  • Reverse engineer, decompile, or disassemble any part of the Service or methodology
  • Create derivative works based on Creative CPM's proprietary algorithms or valuation systems
  • Develop competing products or services that replicate Creative CPM's methodology
  • Extract or scrape benchmark data, outcome valuations, or ratio recommendations
  • Share, sell, or redistribute Creative CPM's proprietary methodology or database content
  • Use the Service to build your own creative valuation tool or platform

© 2026 Creative CPM. All rights reserved. The Creative CPM name, logo, methodology, and all related product and service names are trademarks or registered trademarks of Creative CPM.

3. User License

Subject to your compliance with these Terms, Creative CPM grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business purposes in accordance with your subscription tier.

4. User Data and Reports

4.1 Your Data

You retain all rights to the campaign data, outcomes, and costs you input into the Service. Creative CPM will not share your specific campaign reports with third parties without your explicit consent.

4.2 Aggregated Data

Creative CPM may aggregate and anonymize user data to improve benchmark recommendations, refine outcome valuations, and enhance the Oracle Database. This aggregated data does not identify individual users or specific campaigns.

5. Subscription and Payment

Access to certain features requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on Creative CPM's or any third party's intellectual property rights
  • Transmit any harmful code, viruses, or malicious software
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Interfere with or disrupt the Service or servers

7. Confidentiality

Users acknowledge that the Creative CPM methodology, algorithms, benchmark data, and valuation systems constitute confidential and proprietary trade secrets. Users agree to maintain the confidentiality of these systems and not disclose them to any third party.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Creative CPM does not guarantee that the Service will be error-free, secure, or uninterrupted. Valuation recommendations are provided as guidance and should not be considered financial advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Creative CPM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

10. Termination

Creative CPM reserves the right to suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms or misuse of the proprietary methodology.

11. Changes to Terms

Creative CPM reserves the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Creative CPM operates, without regard to its conflict of law provisions.
